This is important if you use a pest control company. Several weeks ago, I got a call from a fellow who signed a contract with a large, national company. When the technician came to the door to treat, he wasn’t carrying a one gallon hand sprayer that most companies use. This company stopped using them. What he was carrying was an aerosol spray can of pesticide. When he came in, he walked around the house, bent over, and sprayed all of the baseboards with the aerosol pesticide. This is totally ridiculous and totally illegal. The homeowners daughter was sitting on the couch and she started seriously coughing when the technician sprayed the living room. When he left, he said the pesticide was harmless and there was nothing to worry about. The homeowner asked me what to do. I told him that in the past I would have told him to call the company and complain and they would probably fire the guy. However, when a company this large can’t train people properly, we have to go further. I told him that the contract he signed has an section in there that prohibits him from suing the company. He has to go to arbitration which could cost him a lot of money. I asked him if he had any relatives in the city and he said his son lives nearby. I suggested he have his son sue the pest control company for endangering the life of his sister with an illegal pesticide application. I got a call Saturday and he said his son is doing just that as he contacted a lawyer. I suggested he have the attorney sue for a lot of money, in the millions. This company does not want this to come out in public as they won’t want the negativity it will create and they will probably just settle this to stop it and they may settle for a million or so. Remember when Terminix fumigated a house in the West Indies and made some people sick and it cost them several million dollars plus they got a lot of negative publicity. I will post the results of this if it goes to court.
